OFFICIAL CONTEST RULES: “GamesTown 2010 Contest”

IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS ("OFFICIAL RULES") BEFORE PARTICIPATING IN THE “GAMESTOWN 2010 CONTEST” (THE “CONTEST”) ORGANIZED BY HER MAJESTY THE QUEEN IN RIGHT OF THE PROVINCE OF BRITISH COLUMBIA, AS REPRESENTED BY THE MINISTER OF HEALTHY LIVING AND SPORT (THE “PROVINCE”). BY CLICKING THE TERMS AND CONDITIONS ACCEPTANCE BOX AND PARTICIPATING IN THIS CONTEST, YOU REPRESENT THAT YOU SATISFY ALL OF THE ELIGIBILITY REQUIREMENTS IN SECTIONS 2 AND 3 BELOW AND YOU ARE DEEMED TO HAVE READ AND TO HAVE AGREED TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES.

THIS CONTEST IS INTENDED TO BE CONSTRUED AND EVALUATED ACCORDING TO THE LAWS OF BRITISH COLUMBIA AND THE LAWS OF CANADA APPLICABLE TO THE CONTEST. PARTICIPATION IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE OFFICIAL RULES.

1. CONTEST PHASES:


1.1 The Contest consists of the following three phases:

(a) The first phase begins at 1:00 p.m. PST, February 23rd, 2009 and closes at 11:59 p.m. PST October 31, 2009 (the “ Submission Period ”). During the Submission Period , individuals may submit one or more online entries to demonstrate why their community should win the title of “Gold Medal Winner, GamesTown 2010”. Each community for which at least one entry has been submitted during the Submission Period will be eligible to win prizes, as further described below, and will proceed to the second phase of the Contest;

(b) The second phase begins at 12:00 a.m. PST, November 1, 2009 and closes at 11:59 p.m. PST January 4, 2010 (the “ Viewer’s Choice Period ”). During the Viewer’s Choice Period, individuals may continue to submit online entries, as described in sub-paragraph (a) above, for communities for which at least one entry has been submitted during the Submission Period. During the Viewer’s Choice Period, individuals may also vote online for one community in each of five population categories that, in their opinion, best demonstrate enthusiasm for and participation in sport and healthy living initiatives. The two (2) communities in each of the five (5) population categories (for a total of ten (10) communities) that receive the most votes during the Viewer’s Choice Period will proceed to the third phase of the Contest. The five (5) population categories are 0-5000, 5,000-10,000, 10,000-25,000, 25,000-100,000 and >100,000; and

(c) The third phase begins at 12:00 a.m. PST, January 5, 2010 and closes at 11:59 p.m. PST January 18, 2010 (the “Panel Judging Period”).  From the beginning of the Panel Judging Period until 11:59 p.m. PST January 7, 2010 (the “Top 10 Period”), the top ten (10) communities chosen during the Viewer’s Choice Period will be allowed to submit additional entries that will be considered by the panel during the Panel Judging Period.  During the Panel Judging Period, a panel of B.C. celebrity VIPs and athletes will view the entries submitted during the Submission Period, the Viewer’s Choice Period and the Top 10 Period for each of the top ten (10) communities and will choose from these communities a first place, a second place and a third place community.  Individuals may continue to submit online entries during the Panel Judging Period for communities for which at least one entry has been submitted during the Submission Period, but only those entries received during the Submission Period, the Viewer’s Choice Period and the Top 10 Period will be considered by the panel.  The first place community will be awarded the title of “Gold Medal Winner, GamesTown 2010”, the second place community will be awarded the title of “Silver Medal Winner, GamesTown 2010” and the third place community will be awarded the title of “Bronze Medal Winner, GamesTown 2010”.  Each of the top three (3) communities chosen during the Panel Judging Period will also be awarded prizes for distribution within the community, as further described in sections 6 and 7 below,


(the Submission Period, the Viewer’s Choice Period, the Top 10 Period and the Panel Judging Period are collectively referred to as the “Contest Period”).

2. HOW TO PARTICIPATE: NO PURCHASE NECESSARY.

2.1 During the Submission Period, individuals may submit one or more entries online for any community listed at www.GamesTown2010.ca (the “ Website ”). All communities for which at least one entry has been submitted during the Submission Period will be automatically entered in the Contest. Before submitting an entry, individuals are required to: (a) provide their screen name or alias, email address, and the title of their entry; (b) read these Official Rules and the Privacy Statement of the Province; and (c) check the terms and conditions acceptance box to indicate their acceptance of these Official Rules. Individuals may then click on the “Submit Your Entry” box to submit an entry. Individuals may submit multiple entries, but will only be permitted to submit up to three photographs, one video and one story at a time. Additional entries must be made through a separate submission.

2.2 During the Viewer’s Choice Period, individuals may continue to submit entries for any community for which at least one entry has been submitted during the Submission Period. Individuals may also vote online at the Website for one community in each of five population categories that, in their opinion, should proceed to the Panel Judging Period. All voting must be manual. No automated voting is permitted.

2.3 In the event of a dispute as to the identity of the individual who submitted a selected entry with an email address, the selected entry will be deemed to have been made by the Authorized Account Holder (defined below) of the email address at the time of submission of the entry. The “ Authorized Account Holder ” means the natural person who is assigned an email address by an Internet service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning the email addresses for the domain associated with the submitted email address. All entries must be submitted with a valid email account that may be identified by reverse domain name search. Individuals may be required to provide the Province with proof that he or she is the Authorized Account Holder of the email address associated with the selected entry.

3. ELIGIBILITY:

3.1 To be eligible to participate in the Contest by submitting an entry you must: a) be a legal resident of British Columbia who has reached the age of majority at the time of submitting the entry; and b) have an email account registered in your name. A number of Internet service providers and other companies offer free email accounts.

3.2 You are not eligible to participate in the Contest by submitting an entry if you are: a) an employee of the Province or the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (“ VANOC ”); or b) a member of the immediate family (defined as mother, father, brothers, sisters, sons, daughters and husband or wife, regardless of where they reside) or household of an employee of the Province or VANOC. At any time, the Province will have the right to require, from any individual participating in this Contest by submitting an entry, proof of identity and/or eligibility to participate. Failure to provide proof within a reasonable time could result in the removal of the entry from the Website. All personal and other information requested by and supplied to the Province for the purpose of submitting an entry to this Contest must be truthful, complete, accurate and in no way misleading.

3.3 The Province, in its sole discretion, reserves the right to remove any entry from the Website should any individual submitting an entry to this Contest at any stage supply untruthful, incomplete, inaccurate or misleading information and/or personal details.

4. TERMS OF USE FOR ENTRIES:

4.1 You may submit videos through a link to YouTube, photographs in jpg, gif, bmp or png format or stories of up to 500 words (collectively, the “ Content ”) to the Website to demonstrate why your community should win the title of “Gold Medal Winner, GamesTown 2010”.

4.2 The Province reserves the right to review all Content submitted to the Website, and to refuse to display on the Website, and to delete from the server on which the Website is located, any Content that the Province deems, in its sole discretion, to be objectionable or inappropriate, including without limitation any Content that: (a) is obscene; (b) threatens or is hateful towards a specific group of people; (c) is unlawful; (d) advertises private interests; (e) impersonates or falsely claims to represent a person or organization; or (f) invades the privacy of any person or otherwise violates the rights of any person.

4.3 The Province reserves the right in its sole discretion to remove from the Website at any time any Content that potentially or actually infringes any third party’s copyright, trademark, right of privacy, publicity or other intellectual property or other right.

4.4 You retain ownership of all original Content that you submit to the Website. By submitting Content to the Website, and in consideration of the chance for your community to be chosen as one of the top three (3) communities and to win the prizes described below and of the sum of One Dollar and other valuable consideration (the receipt and sufficiency of which you hereby acknowledge), you grant to the Province a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, perform, publish, communicate to the public by telecommunication, modify, display, and distribute the Content in any and all formats, in any and all media, for any and all purposes associated with the Contest.

4.5 You agree that the Province may reformat, rearrange or otherwise modify the Content, and that the Province has no obligation to acknowledge you by name or pseudonym as the author of the Content or to ensure that you remain anonymous.

4.6 You agree that the Province may engage independent contractors and service providers to assist the Province to exercise the rights you grant to the Province under these Official Rules.

4.7  You represent and warrant that:  (a) all Content that you submit to the Website is either your original work or has been provided to you or obtained by you from the rightful owner with all necessary permissions; (b) such Content does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property rights of any person or entity; and (c)  you have obtained, prior to submitting the Content, any necessary releases and consents, including without limitation consent in the form available at: www.gamestown2010.ca/media/consentform.pdf to the collection and disclosure of, and access to, personal information from each identifiable individual whose personal information appears in the Content and releases from each identifiable individual whose image appears in the Content.

4.8  You agree, at the request of the Province, to provide to the Province the releases and consents described in section 4.7(c) above.

 

4.9 You agree that under no circumstances will the Province or any of its respective servants, employees or agents be liable to any person or entity for any direct, indirect, special, incidental, consequential or other damages based on: (a) use of any Content pursuant to these Official Rules; (b) any use by you of the Website or any other website to which the Website is linked; or (c) any failure by you to abide by these Official Rules.

4.10 You agree to indemnify, defend and hold harmless the Province and all of its respective servants, employees and agents from and against all claims, demands, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable legal fees) arising from: (a) your use of the Website or any other website to which the Website is linked; (b) your violation of any provision of these Official Rules; (c) your violation of any third party right, including without limitation any claims or actions based on infringement or violation of intellectual property rights, libel or slander or other defamation, rights of privacy or rights of publicity; and (d) any claim that any Content submitted by you caused damage to a third party.

4.11 You agree, at the request of the Province, to sign a written acknowledgment of your acceptance of these Official Rules, including but not limited to the terms of use set out in this section 4.

5. PRIVACY:

5.1  By participating in this Contest by clicking the terms and conditions acceptance box and submitting an entry, you:  (a) acknowledge that you understand that your personal information (including screen name or alias and email address) is being collected by the Province for the purposes of operating, administering and promoting the Contest; (b) consent to the disclosure of and access to your personal information, to the extent that your personal information appears in your entry, inside or outside of Canada, for any and all purposes in connection with your participation in, and the operation, administration and promotion of, the Contest; and (c) consent to the continued use of your email address for future Ministry of Healthy Living and Sport contests.  Your personal information is collected pursuant to s. 26(c) of the Freedom of Information and Protection of Privacy Act for the purposes set out above in this section 5.1.  All questions regarding the collection, use and disclosure of your personal information may be directed to: Director, Corporate Information Privacy and Records Branch, Ministry of Healthy Living and Sport, 1-1, 1515 Blanshard Street, Victoria, BC, V8W 3C8, (250) 952-0969.  Your personal information will not be provided to any third parties, other than as provided in these Official Rules.

6. PRIZES:

6.1 The prizes will include 69 pairs of tickets to the Vancouver 2010 Olympic and Paralympic Winter Games events, to be distributed between the XXIst Olympic Winter Games events and the Xth Paralympic Winter Games events as set out in this section 6.1. 42 pairs of tickets to the XXIst Olympic Winter Games events will be available to be awarded and 27 pairs of tickets to the Xth Paralympic Winter Games events will be available to be awarded. The specific events for which tickets will be awarded will be determined by the Province in its sole discretion. Retail prize value of a pair of tickets to the XXIst Olympic Winter Games events ranges from approximately $80 to $200. Retail prize value of a pair of tickets to the Xth Paralympic Winter Games events ranges from approximately $20 to $200. The prizes will also include 3 cash rewards totalling $175,000 (1x $100,000; 1x $50,000; and 1x $25,000), 15 ActNow BC Prize Packs (Retail prize value of $1000 for each Prize Pack), 15 Vancouver 2010 Olympic and Paralympic Winter Games Collateral Prize Packs (Retail prize value of approximately $1000 for each Prize Pack), 3 GamesTown 2010 plaques (Retail prize value of approximately $300 for each plaque), 12 visits from one or more Vancouver 2010 Olympic and Paralympic Winter Games athlete(s) (deemed to have no approximate retail value) and 1 Road to 2010 Community Tour Event (deemed to have no approximate retail value). All incidental costs and expenses not specifically referred to in these Official Rules (e.g. travel and meals) are not included and are the sole responsibility of the community receiving the prize or of the individual to whom the community distributes the prize, as applicable.

6.2 No individual prizes will be distributed . All prizes in connection with this Contest will be distributed to communities, as further described in section 6.3 below. Communities receiving a prize are solely responsible for the distribution of prizes within the community. The Province expressly disclaims any responsibility for the distribution of prizes after the prizes have been distributed to the community.

6.3 In order to accept a prize, a community must be either: (a) a “municipality”, as defined in the Local Government Act, R.S.B.C. 1996, c. 323; or (b) a “band”, as defined in the Indian Self Government Enabling Act, R.S.B.C. 1996, c. 219. If a community selected to receive a prize does not meet either of these criteria, the community may propose for the consideration of the Province an alternative entity with which the community is associated to receive the prize. In such an event, the Province may choose, in its sole discretion, to award the prize to the proposed alternative community or to award the prize to another community chosen in accordance with these Official Rules.

6.4 All communities receiving a prize consisting of or including any tickets to the Vancouver 2010 Olympic and Paralympic Winter Games events under these Official Rules will be required to acknowledge that any such tickets must be accepted as awarded, are subject to VANOC’s terms and conditions of use applicable to all ticketholders, and are subject to change without notice. For greater certainty, such tickets are not exchangeable for cash, may not be used in connection with any commercial promotion or contest, and may not be sold for more than the face value of the ticket. Prizes must be accepted as awarded and cannot be transferred, substituted or redeemed for cash. The Province reserves the right, in its sole discretion, to substitute any and all of the prizes of equal value if a prize cannot be awarded as described. The Province will not be responsible, however, if factors beyond the Province’s reasonable control prevent prizes from being fulfilled. In any such event, no substitute prizes or cash equivalents will be provided. Prizes will only be delivered to the verified winning community.

6.5 The Province reserves the right not to award prizes, or to award only some of the prizes, if there is not a sufficient number of communities for which at least one entry has been received to distribute all of the prizes, or if, for any other reason, there is not a sufficient number of communities to which the prizes can be distributed.

7. PRIZES FOR GOLD, SILVER AND BRONZE MEDAL WINNERS:

7.1 At the conclusion of the Contest Period, the top three (3) communities chosen by the celebrity VIP and athlete panel during the Panel Judging Period will be named, in order of their ranking, the Gold Medal Winner, the Silver Medal Winner and the Bronze Medal Winner (collectively, the “ Top Three Communities ”). Judging criteria will include: (a) the level of enthusiasm and participation demonstrated by the community, based on the entries submitted in support of the community and the number of people who participate in the pledge program as described at www.actnow.bc.ca/pledge; and (b) the creativity of the entries submitted in support of the community. The prizes for the Top Three Communities will be as follows:

Silver Medal Winner The Silver Medal Winner will receive:

- 1 x $50,000 Cash Reward
- 2 Pairs of tickets (4 tickets total) to the XXIst Olympic Winter Games Events (events to be determined by the Province in it sole discretion)
- 2 Pairs of tickets (4 tickets total) to the Xth Paralympic Winter Games Events (events to be determined by the Province in it sole discretion)
-1 x Plaque identifying the community as “Silver Medal Winner, GamesTown 2010”
Bronze Medal Winner The Bronze Medal Winner will receive:

- 1 x $25,000 Cash Reward
- 1 Pair of tickets (2 tickets total) to the XXIst Olympic Winter Games Events (events to be determined by the Province in it sole discretion)
- 1 Pairs of tickets (2 tickets total) to the Xth Paralympic Winter Games Events (events to be determined by the Province in it sole discretion)
-1 x Plaque identifying the community as “Bronze Medal Winner, GamesTown 2010”


7.2 Each of the Top Three Communities will be contacted by email or phone and asked to provide a designated representative of the community with authority to act on behalf of the community (the “ Community Representative ”) to respond on behalf of the community. The Community Representative will then be notified by email and asked to respond within a specified time period. If a Community Representative does not respond to the notification within the specified time period, or the community is otherwise unwilling or unable to comply with these Official Rules, the community will be disqualified and another community will be selected from the top ten (10) communities chosen during the Viewer’s Choice Period. If the Community Representative responds to the Province within the specified time period, the community will be declared a winner provided that the community complies with the requirements of Section 9 below. Upon responding to the Province, the Community Representative will be advised of prize delivery method. Prizes may be delivered via mail or courier, or may be picked up by the Community Representative, and are subject to the discretion of the Province and to the Province receiving the Release (defined in Section 9) prior to awarding the winning prizes. The Province is not responsible for the failure for any reason whatsoever of any Community Representative to receive notification or for the Province to receive a Community Representative’s response.

7.3 Each of the Top Three Communities will be required to use the cash reward to support the improvement of a community facility or initiative that is dedicated to supporting sport, fitness or healthy living. The community will be responsible for determining the facility or initiative to which the cash reward will be applied.

8. RANDOM PRIZE DRAWS:

8.1 In addition to the prizes for the Top Three Communities, all communities for which at least one entry has been submitted during the Submission Period will be eligible for prize draws. A total of seven prize draws will be conducted: one on March 11, 2009; one on April 15, 2009; one on May 13, 2009; one on June 17, 2009; one on July 8, 2009; one on August 12, 2009; and one on November 23, 2009. The prizes for each draw are described below. Communities will be selected randomly from the list of communities for which at least one entry has been submitted during the Submission Period. Non-winning communities will be re-entered into the next draw.

8.2 Communities selected during a draw will be contacted by email or phone and asked to provide a Community Representative to respond on behalf of the community. The Community Representative will then be contacted by email and an acceptance email or phone call reply must be made to the Province by the Community Representative within 48 hours of such notification. If a Community Representative does not respond in accordance with these Official Rules or the community is otherwise unwilling or unable to comply with these Official Rules, the community will be disqualified and another community will be selected. If a Community Representative responds to the Province within 48 hours from receiving notification, the Province will contact the Community Representative and will administer, by phone, a skill-testing, time limited mathematical question [(3x3) + (4x4)] in order for the community to become a winner and receive the winning prizes. If the Community Representative answers the mathematical question correctly, the community will be declared a winner provided that the community complies with the requirements of Section 9 below. Upon answering the mathematical question correctly, the Community Representative will be advised of prize delivery method. Prizes may be delivered via mail or courier, or may be picked up by the Community Representative, and are subject to the discretion of the Province and to the Province receiving the Release (defined in Section 9) prior to awarding the winning prizes. The Province is not responsible for the failure for any reason whatsoever of any Community Representative to receive notification or for the Province to receive a Community Representative’s response. Odds of winning will depend on the total number of communities for which at least one entry has been submitted during the Submission Period.

Eight (8) winning communities will be awarded the following prize:
- 1 x Pair of tickets (2 tickets total) to the Xth Paralympic Winter Games Events (events to be determined by the Province in it sole discretion)

Six (6) winning communities will be awarded the following prize:
-1 x Visit from one or more Vancouver 2010 Olympic and/or Paralympic Games athlete(s) (either before or after the close of the Vancouver 2010 Olympic and Paralympic Winter Games and the Contest Period)

August 12, 2009 Three (3) winning communities will be awarded the following prize:
- 1 x Pair of tickets (2 tickets total) to the XXIst Olympic Winter Games Events (events to be determined by the Province in it sole discretion)

Three (3) winning communities will be awarded the following prize:
- 1 x Pair of tickets (2 tickets total) to the Xth Paralympic Winter Games Events (events to be determined by the Province in it sole discretion)

One (1) winning communities will be awarded the following prize:
-1 x Visit from one or more Vancouver 2010 Olympic and/or Paralympic Games athlete(s) (either before or after the close of the Vancouver 2010 Olympic and Paralympic Winter Games and the Contest Period)

November 23, 2009 One (1) winning community will be awarded the following prize:
-1 x Road to 2010 Community T our Event, a one-day event offering a range of experiences for children and their families, which may include some or all of the following:

  • Vancouver 2010 Olympic Games torch prototype
  • Vancouver 2010 Olympic and/or Paralympic Games mascots
  • One or more Actnow BC athlete ambassadors (Olympic and/or paralympic Games athlete(s))
  • Motivational speakers
  • SportFit profiling
  • Run, jump, throw activities
  • Real sports equipment show and tell (eg, luge, bobsled)
  • Interactive games
  • World Healthy Living Challenge Pledge station
  • Healthy snacks

Five (5) winning communities will be awarded the following prize:

December 9, 2009 Ten (10) winning communities will be awarded the following prize:
- 1 x Pair of tickets (2 tickets total) to the XXIst Olympic Winter Games Events (events to be determined by the Province in it sole discretion)


9. RELEASE:

9.1 Before being declared a winning community, each community notified of its selection will be required to execute a legal agreement and release (the “ Release ”) indicating that the community: (a) has the necessary legal capacity to enter into the Release; (b) will keep the notification confidential until the official public announcement has been made and the Province informs the community in writing that the community may disclose the notification; (c) agrees to comply with these Official Rules; (d) accepts the winning prize as offered; (e) releases each of the Province, its servants, agents, employees, licensees, and assignees and VANOC (the “ Released Parties ”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, or the acceptance, possession, use, or misuse of any prize, including without limitation, costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (f) will obtain all releases and permissions necessary to grant the Province the unrestricted right to publish without any further compensation the name, photograph, portrait, likeness, audio-video recording, interview, voice and any website dissemination or broadcast thereof of any official spokesperson of the community for the purposes of advertising and promoting the Contest and awarding or publishing the winning prizes. The Release document may contain such other terms and conditions as the Province, at its sole discretion, may decide. The Release document must be returned by the date indicated on the document or the winning prizes will be forfeited.

10. INDEMNIFICATION BY PARTICIPANT:

10.1 By participating in the Contest, each participating individual hereby releases the Released Parties from any and all liability whatsoever, and waives any and all causes of action, related to any injuries, loss or damage of any kind to any person or persons (including, without limitation, death or personal injury, property damage, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) resulting in whole or in part, directly or indirectly, from participation in the Contest.

11. LIMITATION OF LIABILITY:

11.1 Under no circumstances will the Province be liable to any person or business entity for any direct, indirect, special, incidental, consequential, or other damages based on any use of the Website or any other Website to which the Website is linked, including, without limitation, any lost profits, business interruption, or loss of programs or information, even if the Province has been specifically advised of the possibility of such damages. The Province assumes no responsibility for failure of the Internet or the Website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the Internet or at any website, or any combination thereof or other failures related to hardware, software or virus, or incomplete, illegible, lost, late or misdirected entries or votes. The Province reserves the right, in its sole discretion, to cancel or suspend this Contest if a virus, bug or other cause beyond its reasonable control corrupts the security or proper administration of the Contest. Any attempt to deliberately damage the Website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. If such an attempt be made, the Province reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

12. MISCELLANEOUS:

12.1 All decisions of the Province will be final and binding in all matters relating to this Contest. The Province reserves the right, without prior notice, to cancel, terminate or modify the Contest, including these Official Rules, if it cannot be operated, conducted or completed as planned, for any reason. If any term or provision of these Official Rules is invalid, illegal or unenforceable, all other terms and provisions of these Official Rules will nonetheless remain in full force and effect.

13. LAWS:

13.1 This Contest is subject to federal, provincial and municipal laws and regulations. These Official Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws.
